Terms of Use for Gjesp

1. Introduction and Acceptance

These Terms of Use ("Terms") govern your use of the Gjesp mobile application ("App"), operated by LIMOLI AS (org.nr. 930299049), located at Bjarne Haugens gate 31, 1475 Finstadjordet, Norway ("we", "us", or "our").

By creating an account and using Gjesp, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. About Gjesp

Gjesp is a platform that helps users discover local events and activities, connect with their communities, and support local organizers. The App collects and displays events in an intuitive interface, encouraging real-world experiences over digital noise.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 15 years old to use Gjesp. This requirement is enforced through our authentication provider, Vipps.

3.2 Account Creation

To use Gjesp, you must create an account by logging in through Vipps. By doing so, you authorize us to receive your basic information (name, email, phone number, address) from Vipps.

3.3 Account Security

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use at support@gjesp.com.

4. User Types

4.1 Regular Users

All registered users can browse events, mark events as favorites, and interact with content in the App.

4.2 Event Organizers / Business Owners

Any user can register a business to become an event organizer. To do so, you must provide a valid organization number (orgnr.), and your personal information must match the records in the Bronnøysund Register Centre (BRREG). We verify this information to ensure legitimacy.

5. Event Submission and Content Guidelines

5.1 Event Submission

Event organizers can submit events through the App. All submitted events are subject to quality review by our team. We reserve the right to approve or reject any event at our sole discretion.

5.2 Event Limits

Free accounts have a limited number of events that can be active per month. Subscriptions increase these limits and unlock additional features.

5.3 Rejected Events

If your event is rejected during quality review, it still counts toward your monthly event limit. However, you may delete the rejected event to reclaim that slot and submit a new event.

5.4 Content Standards

When submitting events or uploading content (such as images or logos), you agree that your content:

• Is accurate and not misleading
• Does not infringe on any third party's intellectual property rights
• Does not contain illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable material
• Complies with all applicable Norwegian laws and regulations
• Does not promote discrimination, violence, or illegal activities

5.5 Content Ownership and License

You retain ownership of the content you submit. By submitting content to Gjesp, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the App and for promotional purposes related to Gjesp.

6. Subscriptions and Payments

6.1 Subscription Services

Gjesp offers subscription plans that provide extended event limits, access to statistics, and other premium features. Subscription details and pricing are displayed in the App.

6.2 Payment Processing

All payments are processed securely by Stripe. We do not store your payment card details. By making a purchase, you agree to Stripe's terms of service.

6.3 Billing

Subscriptions are billed on a recurring basis according to the plan you select. You authorize us to charge your payment method for all fees associated with your subscription.

6.4 Cancellation

You may cancel your subscription at any time through the App or your app store account settings. Cancellation will take effect at the end of the current billing period. You will retain access to premium features until that time.

6.5 Refund Policy

Due to the digital nature of our services and their low price point, we do not offer refunds for subscription payments. Once a payment is processed, it is final.

6.6 Right of Withdrawal

Under Norwegian consumer law (Angrerettloven), you have a 14-day right of withdrawal for online purchases. However, for digital services that begin immediately, you may waive this right. By purchasing a subscription and consenting to immediate access, you acknowledge that you lose your right of withdrawal once the service begins.

7. Statistics for Event Organizers

Event organizers with eligible subscriptions have access to statistics about their events, such as views and favorites. All statistics are provided in an aggregated and anonymized format. Organizers cannot identify individual users who have interacted with their events.

8. Prohibited Conduct

When using Gjesp, you agree not to:

• Violate any applicable laws or regulations
• Submit false, misleading, or fraudulent information
• Impersonate any person or entity
• Use the App to send spam or unsolicited communications
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App without permission
• Circumvent any technical measures we use to protect the App

9. Intellectual Property

The Gjesp App, including its design, features, content (excluding user-generated content), logos, and trademarks, is owned by LIMOLI AS and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.

10. Disclaimer of Warranties

Gjesp is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be uninterrupted, secure, or error-free
• Events listed on the App are accurate, reliable, or will occur as described
• Any defects will be corrected

We are not responsible for the quality, safety, or legality of events listed by organizers. Users attend events at their own risk.

11. Limitation of Liability

To the maximum extent permitted by Norwegian law, LIMOLI AS and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Loss of profits, data, or goodwill
• Personal injury or property damage resulting from attending events
• Unauthorized access to your account
• Errors or omissions in any content

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless LIMOLI AS and its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications to the App and Terms

13.1 Changes to the App

We reserve the right to modify, suspend, or discontinue any part of the App at any time without prior notice.

13.2 Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Submitting prohibited content
• Fraudulent or illegal activity
• Extended period of inactivity

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Norway. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the Norwegian courts, with venue in Oslo.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LIMOLI AS regarding your use of Gjesp and supersede any prior agreements.
